What the bond actually guarantees

Oregon licenses pawnbrokers through the Department of Consumer and Business Services under ORS chapter 726. ORS 726.070 — "Applicant to furnish bond or letter of credit" — requires a $25,000 bond executed by the applicant as obligor, together with a surety company authorized to do business in Oregon, to accompany the application and be maintained with the director.

The bond runs to the State of Oregon and for the use of the state and of any person who may have a cause of action against the obligor. It conditions you to faithfully conform to and abide by the pawnbroker chapter and to pay the state and any such person all money that becomes due or owing — the customer-protection backstop behind pledge tickets, redemption periods, and permitted charges.

An irrevocable letter of credit in the same $25,000 amount, issued by an insured institution as defined in ORS 706.008, can be filed instead. It is not insurance for you — if the surety pays a claim, you repay the surety, and the bond has to be maintained for as long as the licence is active. We track the term and send renewal notices 60 and 30 days out.

ORS 726.070ORS 726.070, "Applicant to furnish bond or letter of credit," requires a bond in the sum of $25,000 executed by the applicant as obligor, together with a surety company authorized to do business in this state as surety — or an irrevocable letter of credit issued by an insured institution as defined in ORS 706.008 in the amount of $25,000 — to accompany the pawnbroker licence application and be maintained by the licensee with the Director of the Department of Consumer and Business Services. The bond runs to the State of Oregon and for the use of the state and of any person who may have a cause of action against the obligor, conditioned that the pawnbroker will faithfully conform to and abide by the provisions of the chapter and pay to the state and to any such person all money that may become due or owing.
