What the bond actually guarantees

A viatical settlement provider is the party that actually buys a life insurance policy from its owner. Oklahoma licenses providers through the Insurance Commissioner under the Viatical Settlements Act, 36 O.S. §§ 4055.1–4055.17, and 36 O.S. § 4055.3 conditions that license on evidence of financial responsibility in the amount of $50,000, filed alongside a plan of operation and an antifraud plan.

The statute lets you satisfy it with a surety bond issued by an insurer authorized to write surety in Oklahoma, a policy of errors and omissions insurance, a deposit of cash, certificates of deposit or securities, or any combination — the bond is simply the least capital-intensive of those routes. The obligee is the State of Oklahoma through the Insurance Department, and the protected parties are the viators whose policies you buy.

It is not insurance for you — if the surety pays a claim, you repay the surety. The license renews annually and the financial-responsibility evidence has to stay in force behind it, so we track the term and send renewal notices 60 and 30 days out.
