What the motor fuel tax bond covers

Oklahoma collects its motor fuel excise tax at the supplier level under the Motor Fuel Tax Code, 68 O.S. § 500.1 et seq. Suppliers, permissive suppliers, and bonded importers license with the Oklahoma Tax Commission and post a surety bond on form BT-168 guaranteeing the tax they collect and remit.

For suppliers and bonded importers, the bond is generally not less than three months’ estimated tax liability, with a statutory floor of $100,000 and a cap of $2,000,000. In lieu of a bond, an applicant may show proof of financial responsibility — generally a $5,000,000 net worth. The Tax Commission can also require a purchaser that pays tax to a supplier to post a bond.
