What the fundraiser bond actually guarantees

A professional fundraiser solicits charitable contributions for compensation — and because the money belongs to the charity and its donors, North Dakota requires a bond standing behind the fundraiser's honesty. The bond is filed with the Secretary of State as a condition of registration.

The bond is $20,000, with the fundraiser as principal, and it applies to North Dakota and to any person who has a claim against the fundraiser for liabilities arising from the fundraiser's conduct. (A fundraiser may satisfy the requirement with more than one bond as long as they total at least $20,000.)

The bond must stay in effect for the entire term of registration, and a fundraiser files a continuance certificate each year alongside a new registration statement. If the surety pays a claim, the fundraiser repays the surety. We track the renewal so your registration never lapses.

N.D.C.C. ch. 50-22North Dakota's charitable solicitation law (N.D.C.C. ch. 50-22) requires a professional fundraiser to file a $20,000 surety bond with the Secretary of State, with the fundraiser as principal obligor, applying to any person with a claim arising from the fundraiser's conduct. The bond must remain in effect for the full term of registration, with an annual continuance certificate. A fundraiser may use more than one bond totaling at least $20,000.
