About this bond

What it is and who needs it.

What the bond actually guarantees

North Carolina regulates prepaid health-club memberships under the Prepaid Entertainment Contracts article of the General Statutes (Chapter 66, Article 21). Before selling a contract for services available on the day of sale, a seller must post a surety bond in favor of the State of North Carolina, in a form approved by the Attorney General, equal to the greater of your outstanding member liabilities or $10,000, up to a $250,000 cap per facility. This SKU is the $25,000 amount our carrier packages for Anytime Fitness franchise locations, which sits inside that statutory range.

It's a three-party arrangement: you (the principal, the franchise location), the surety carrier, and the State of North Carolina (the obligee), with your members as the protected interest. A member damaged by the closing of your facility or your bankruptcy can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. The statute directs filing with the Attorney General within 90 days of your first membership sale and updated filings at 180-day intervals after that, so keep your bond current and confirm your specific filing amount and schedule with the Attorney General's office and your Anytime Fitness franchise consultant.

N.C. Gen. Stat. § 66-124North Carolina General Statutes § 66-124 requires a seller of a prepaid entertainment contract — which § 66-118 defines to include health-club and fitness-facility memberships — to post a surety bond in favor of the State, in a form the Attorney General approves, equal to the greater of $10,000 or outstanding buyer liabilities, capped at $250,000 per facility, filed within 90 days of the first sale and at 180-day intervals thereafter. That same section lets a buyer damaged by a facility closing or the seller's bankruptcy bring an action against the bond. This SKU is fixed at the $25,000 amount our carrier uses for Anytime Fitness locations; confirm your exact required amount with the Attorney General's office if your outstanding liabilities exceed that figure.
