What the $2,000,000 bond actually does

New York registers registered organizations — the licensees that manufacture and dispense medical cannabis at retail dispensing facilities — through the Cannabis Control Board and the Office of Cannabis Management. Under Cannabis Law § 35, an applicant must show it possesses or has the right to use sufficient real property, buildings, and equipment to carry out its application — or, in the alternative, post a bond of not less than $2,000,000.

It's a three-party arrangement: your organization (the principal), the surety carrier, and the State of New York (the obligee). The bond stands behind the commitments in your registration — if the state suffers a covered loss because the organization fails to meet them, it can recover against the bond up to the $2,000,000 penal sum.

It is not insurance for you — if the surety pays a claim, you repay the surety. Registrations run on a two-year cycle with renewal filings due months before expiration, so the bond has to stay continuously in force; we track the term and send renewal notices 60 and 30 days out.
