What the foreign collection agency bond guarantees

Nevada does not make every out-of-state collector take a full license. NRS 649.171 lets a person who is not licensed in Nevada as a collection agency apply to the Commissioner of Financial Institutions for a certificate of registration as a foreign collection agency, with an application fee of $500 and limits on the business practices the certificate allows.

The bonding requirement is not lighter. A registrant must deposit and maintain a bond, or an appropriate substitute, in the same manner as an applicant or licensee under NRS 649.105, 649.115 and 649.119 — the same $35,000 baseline running to the State of Nevada, stepped by the Commissioner against average monthly trust account balance.

The bond is conditioned on paying collection proceeds over to customers as agreed and complying with Chapter 649, and the Commissioner can take disciplinary action against a certificate holder under NRS 649.385, 649.390 and 649.395. It is not insurance for you: if the surety pays a claim, you repay the surety.
