What the bond actually guarantees

Nevada regulates credit service organizations — businesses that sell services to improve a consumer's credit record, history, or rating — inside the Deceptive Trade Practices chapter, NRS 598.701 to 598.787. Registration runs through NRS 598.721 with the Division of Mortgage Lending, and NRS 598.752 requires the organization to deposit security of $100,000 before it advertises its services or conducts business in the State.

The security is conditioned on the organization's compliance with the statutory conduct rules and with the terms of its contracts with buyers. It is a three-party arrangement: you (the principal), the surety carrier, and the State of Nevada (the obligee) for the benefit of your customers.

It is not insurance for you — if the surety pays a claim, you repay the surety. Registration has to stay current and the security has to stay continuously on deposit, so we track the term and send renewal notices 60 and 30 days out. A salesperson or agent of a registered organization does not deposit separate security.

NRS 598.752 (with NRS 598.721 and 598.726)Before advertising its services or conducting business in Nevada, a credit service organization must register under NRS 598.721 and deposit security in the amount of $100,000 with the Division pursuant to NRS 598.726. The security is conditioned on the organization complying with NRS 598.746 to 598.772, inclusive, and with the terms of its contracts with buyers. A salesperson, agent, or representative of an organization that has deposited the required security is not required to deposit separate security.
