What the fuel distributor bond actually covers

Montana taxes motor fuel at the distributor level — the licensed distributor collects the gasoline and special fuel tax for the Department of Transportation. Before doing business, a distributor (including importers and exporters) must apply for a license under MCA 15-70-402 and post security in an amount the department determines.

The security is usually a surety bond, payable to the State of Montana, conditioned on the faithful performance of the distributor's duties — paying all fuel taxes and penalties when due. The amount is generally set at twice the distributor's estimated monthly tax liability, and by law it is never more than $100,000.

If a distributor fails to remit the tax it collected, the state can recover against the bond. We issue the amount the department set, at a flat 3% with no credit check — and if the surety ever pays a claim, you repay the surety. It's a guarantee that backs your license, not insurance for you.
