What the right of way bond actually covers

To install or maintain facilities on the Missouri state right of way — a utility line, a commercial driveway, or other work in the highway corridor — you need a permit to work on the right of way from the Missouri Highways & Transportation Commission, administered by MoDOT. The district can condition that permit on a performance bond.

The bond guarantees you complete the work to MoDOT's standards and restore the right of way, following the utility and relocation rules in 7 CSR 10-3 and the terms of your permit. Utility work, in particular, must be located and performed in accordance with those regulations. The Commission is the obligee.

Not every permit requires a bond — MoDOT may instead take a refundable surety deposit, and small jobs sometimes need neither. When a performance bond is required, the Commission sets the amount based on the work, and we issue it at a flat 3% with no credit check. Confirm the amount on your permit.
