What the bond actually guarantees

The Mississippi S.A.F.E. Mortgage Act requires mortgage loan originators to be covered by a surety bond, and an originator who is an employee or exclusive agent of a licensed entity is covered by that entity's bond — which is why the licensed broker carries the filing. The commissioner sets the penal sum based on loan activity during the previous year, and it may not exceed $25,000 for a mortgage broker.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Mississippi (the obligee). The bond runs first in favor of the state for the use, benefit, and indemnity of any person who suffers damage or loss from a breach of contract or violation of law, and second for the payment of civil penalties, criminal fines, or costs of investigation and prosecution incurred by the state.

It is not insurance for you — if the surety pays a claim, you repay the surety. Because the amount is recalculated from prior-year volume, the required penal sum can move at renewal; we track the term and send renewal notices 60 and 30 days out.
