What the bond actually guarantees

The Mississippi Check Cashers Act licenses businesses that cash checks, drafts, or money orders for a fee, through the Department of Banking and Consumer Finance. Among the eligibility requirements, an applicant must file with the commissioner a bond with good security in the penal sum of $10,000, payable to the State of Mississippi — cash, a certificate of deposit, or government bonds of $10,000 may be filed in lieu.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Mississippi (the obligee). The bond stands behind your faithful performance of the duties and obligations of the licensed business and the prompt payment of any judgment recovered against you on account of charges or other claims arising directly or collectively from a violation of the article — the fee-cap, disclosure, and deferred-deposit rules that protect customers.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond is not valid until the commissioner approves it, so it has to be on file before the license issues and stay on file after; we track the term and send renewal notices 60 and 30 days out.

Code Ann. § 75-67-509Section 75-67-509 sets the applicant eligibility requirements under the Mississippi Check Cashers Act, including that the applicant file with the commissioner a bond with good security in the penal sum of $10,000, payable to the State of Mississippi for the faithful performance by the licensee of the duties and obligations pertaining to the business so licensed and the prompt payment of any judgment which may be recovered against the licensee on account of charges or other claims arising directly or collectively from any violation of the article. The applicant may file, in lieu of the bond, cash, a certificate of deposit, or government bonds in the amount of $10,000, and the bond is not valid until it is approved by the commissioner.
