What the bond actually guarantees

Mississippi's health spa law conditions the right to sell health club or health spa memberships on filing a registration statement with the Attorney General's Division of Consumer Protection and posting a $25,000 surety bond with the Office of the State Treasurer — or an equivalent cash deposit — in favor of the State of Mississippi. Anytime Fitness's own franchise agreement asks its Mississippi locations for the same $25,000 figure, so a franchisee satisfies both requirements with a single filing.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Mississippi (the obligee), with your members as the protected parties. If your club takes prepaid dues and then closes early, or otherwise fails to deliver on a membership contract through fraud, dishonesty, or nonperformance, a damaged member can bring a claim against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. If ownership of the bonded club changes hands, the statute requires the new owner to notify the Office of the State Treasurer of the change as a condition of continuing to do business.

Code Ann. § 75-83-3Mississippi Code § 75-83-3 requires any person, corporation, partnership, association, or group intending to open or operate a health spa to register with the Attorney General's Division of Consumer Protection before selling memberships and to post a $25,000 surety bond — or a cash deposit in like amount — with the Office of the State Treasurer, in favor of the State of Mississippi, for the benefit of any person damaged by fraud, dishonesty, or a health spa's failure to perform its contract.
