What the Anoka tree care license bond guarantees

Anoka regulates commercial tree work through Chapter 22 (Businesses and Services), Article II (Arborists and Tree Care) of its City Code. Section 22-42 makes it unlawful for any person to conduct, as a business, the cutting, trimming, pruning, removal, spraying, or otherwise treating of trees in the city without first securing a City license, and Section 74-58 of the vegetation chapter repeats that every tree care firm working in Anoka must hold that license. The City's tree care licensing page notes that licensed firms may work in Anoka whether or not the business is based there, so out-of-town companies take the same license.

Section 22-45 adds the bond: no license shall be issued until the applicant provides a $2,500 bond to the City, in a form the City approves as to security. It sits beside two other conditions in the same article — public liability insurance naming the City as an additional insured (Sec. 22-44), and, for anyone applying chemical treatments, proof of state commercial pesticide applicator certification (Sec. 22-46). New licenses go to the City Council for approval, and the license runs on an annual cycle with the fee set by the Council.

It is a three-party arrangement: you (the principal), the surety carrier, and the City of Anoka (the obligee). It is not insurance for you — if the surety pays the City for a loss caused by your failure to meet the terms of your license, you repay the surety. The same carrier form can also serve an Anoka right-of-way registrant, but that is a different bond: under Sec. 54-82 the City sets the performance and restoration amount in its sole discretion, up to 100 percent of the estimated cost of the work, so contact us with the City's figure rather than using $2,500.
