What the driveway bond actually covers

A driveway that connects to a county road sits partly in the public right-of-way — usually about 33 feet from the centerline on each side. The Berrien County Road Department issues a right-of-way / driveway permit for new installation or resurfacing and conditions it on a surety bond, so the road and drainage are protected.

It is a three-party arrangement: you (the principal), the surety carrier, and the Berrien County Road Department (the obligee). If the driveway work damages the pavement, shoulder, or drainage and you do not repair it, the Department can recover against the bond.
