A motor club is the business behind roadside assistance, towing reimbursement, map and trip service, bail bond and legal-fee benefits, and the other membership services Maryland groups under Insurance Article Title 26. A person may not provide motor club service or engage in the business of a motor club in the State without a licence from the Maryland Insurance Administration, and the licence carries a financial-responsibility filing on top of the § 26-202 capital and surplus minimums.
Section 26-204 gives three ways to satisfy it: registered United States government bonds with a market value of at least $100,000, a corporate surety bond in a penal sum of at least $100,000, or a letter of credit for at least $100,000 — each deposited with the State Treasurer, and each subject to the Commissioner’s discretion to accept a lower figure down to a $15,000 floor. The surety bond is the option that does not tie up a six-figure balance.
The bond runs in favour of the State for the club’s Maryland members and is conditioned on the faithful performance of the club’s obligations under Title 26, including payment of any fines, fees, penalties, or restitution ordered. It is not insurance for the club — if the surety pays, the club repays the surety. Motor club licences expire annually on 31 December, and § 26-204 requires the security to be maintained as long as the licensee has any outstanding liability or obligation in the State.
