About this bond

What the deposit bond actually covers

Maryland's Home Builder Registration Act (Business Regulation Title 4.5) requires anyone who builds new homes for sale to register with the Home Builder Registration Unit, administered by the Office of the Attorney General's Consumer Protection Division.

A registered builder who receives payment on a contract before a home is complete must obtain and maintain a surety bond (or a letter of credit) as a condition of registration. The bond stands behind the consumer's deposit, so a buyer can recover if the builder takes the money and does not finish the home.

It is not insurance for you. If the surety pays a buyer's claim, you repay the surety. The exact bond amount is set in connection with your registration and the deposits you take — confirm the figure with the Registration Unit, and we issue it at a flat 3% with no credit check.

Business Regulation Title 4.5 (Home Builder Registration)Maryland's Home Builder Registration Act (Business Regulation Article, Title 4.5) requires new-home builders to register with the Home Builder Registration Unit and, for builders who accept deposits before completing a home, to maintain a surety bond or letter of credit protecting those deposits. The Act also funds a separate Home Builder Guaranty Fund (Subtitle 7). Confirm your required bond amount with the Registration Unit.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the Maryland home builder deposit bond? +
The premium is a flat 3% of the bond amount, with a $275 minimum. The amount itself is set in connection with your registration and the deposits you accept — enter that figure and the quote updates.
Do all home builders need this bond? +
Not every registrant. The deposit bond requirement applies to builders who take payment on a contract before a new home is complete. If you do not collect pre-completion deposits, confirm with the Registration Unit whether a bond is required.
Is this the same as the Home Builder Guaranty Fund? +
No. Title 4.5 also funds a separate Home Builder Guaranty Fund (Subtitle 7) that compensates consumers for builder losses. The deposit bond is a distinct registration requirement that backs deposits you accept before completion.
Is there a credit check? +
No — the home builder deposit bond is issued with no credit pull. Larger bond amounts may get a quick soft-pull review, which never affects your credit score.
Where do I file it? +
With the Maryland Home Builder Registration Unit, part of the Attorney General’s Consumer Protection Division. We issue the executed bond ready to submit with your registration.
