What the alcoholic beverage tax bond covers

Louisiana taxes alcoholic beverages under the Alcoholic Beverage Tax Law (La. R.S. 26:341 et seq.), collected by the Department of Revenue. A manufacturer or wholesale dealer that owes this excise tax must post a financial guarantee so the state is protected on the tax due before it is remitted.

Under La. R.S. 26:348 and 26:350, the guarantee — a surety bond, certificate of deposit, or letter of credit — must be at least $10,000 for each type of permit held. The bond (Form ABT-SURETY) obligates you to perform the conditions of the tax law and pay all taxes, penalties, and costs.

The bond stands behind the tax you collect or owe — if you fail to remit, the state can recover against it. It is a continuing bond, terminable on thirty days' notice. We issue the amount the Department set, at a flat 3% with no credit check.
