Under 605 ILCS 5/9-113, anyone placing or maintaining utilities within the right-of-way of an interstate, U.S. route, Illinois route, or state-maintained roadway needs an IDOT utility permit. After reviewing the application, the district can require a bond as a condition of the permit.
The bond guarantees the permittee performs the utility work to IDOT's standards and restores the right-of-way — backfilling, repaving, and returning the road to its original condition or better. If the work is left unfinished or the road is damaged and not repaired, IDOT can recover against the bond.
