About this bond

What it is and who needs it.

What the bond actually guarantees

Georgia conditions malt-beverage licenses — importers, wholesalers, and brewpubs — on a $5,000 performance and tax liability bond posted with the Commissioner through the Department of Revenue’s Alcohol & Tobacco Division. The bond is a tax-and-compliance guarantee: it stands behind your timely remittance of the taxes due on malt-beverage sales.

It’s a three-party arrangement: you (the principal), the surety carrier, and the State of Georgia through the Department of Revenue (the obligee). If a licensee fails to remit malt-beverage taxes or otherwise violates the code, the state can recover against the bond up to $5,000.

It is not insurance for you — if the surety pays a claim, you repay the surety. Under the statute the bond can run up to several years; we track yours and send renewal notices 60 and 30 days out so it never lapses.

O.C.G.A. § 3-5-25.1 (Dept. of Revenue)O.C.G.A. § 3-5-25.1 conditions Georgia malt-beverage licenses (importers, wholesalers, brewpubs) on a $5,000 performance and tax liability bond posted with the Commissioner, in the amount and under the conditions the statute specifies, guaranteeing the timely payment of malt-beverage taxes. The Department of Revenue provides the official bond forms; confirm which applies to your license type.

You need this bond if you’re

A malt-beverage importer licensed through the Alcohol & Tobacco Division
A malt-beverage wholesaler distributing beer in Georgia
A brewpub subject to the performance and tax bond requirement
Renewing or reinstating a malt-beverage license that requires the bond

Five minutes. The whole thing.

These are the actual issuing fields — no credit check section, because this bond doesn’t have one.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the Georgia malt beverage tax bond? +
The premium is $275 — our minimum. The bond amount is a fixed $5,000, and 3% of that is $150, below our $275 floor, so $275 is the price for every licensee.
Which malt beverage license types need this bond? +
It applies to malt-beverage importers, wholesalers, and brewpubs under O.C.G.A. § 3-5-25.1. The Department of Revenue provides a specific form for each — we issue the one your license type requires.
Do I pay the $5,000? +
No. You pay $275. The $5,000 is the surety’s maximum liability to the state if you fail to remit malt-beverage taxes — not a deposit, and nobody holds your money.
Is there a credit check? +
Not on this bond — the application has no credit section at all. Small fixed-amount tax bonds like this one don’t need one.
Where do I file it? +
With the Department of Revenue’s Alcohol & Tobacco Division, alongside your malt-beverage license application. We deliver the executed bond ready to file.
