Florida does not make everyone queue at a driver license office for the road test. Under §322.56, Florida Statutes, the Department may by contract, interagency agreement, or interlocal agreement authorize a person or entity — a commercial driving school, a county tax collector's office, a public or private corporation, a school — to administer driver license examinations, and the test the third party gives must be the same test the state would otherwise give. The statute also requires the contract to allow inspections, annual on-site review, examiner qualification standards matching the Department's own, and random re-testing of approved drivers.
That is where the bond comes in. Because a third party administrator collects fees and issues a result the state will act on, the Department conditions the Class E driving skills authorization on a $200,000 performance bond, filed with the administrator agreement. It backs the administrator's compliance with chapter 322, the Department's rules in Rule chapter 15A-1, Florida Administrative Code, and the terms of the driving skills exam agreement itself — so if an administrator commits fraud, misapplies exam fees, or breaches the agreement, the Department and harmed test-takers can recover against it.
Two things surprise new administrators. First, the knowledge exam and the driving skills exam are bonded separately, each at $200,000; an operation authorized for both carries $400,000 in aggregate across two bonds. Second, it is not insurance for you — if the surety pays a claim, you repay the surety. The bond must stay active for the life of the agreement, so we track it and notify you at 60 and 30 days to keep the filing continuous.
