What the St. Petersburg performance bond covers

The City of St. Petersburg requires every provider to post security before it accepts a right-of-way construction permit. City Code § 25-299 defines a provider as anyone who owns or operates a system providing communications or wireless services, a wireless infrastructure provider, or a public utility without a City franchise. The security is a performance bond, a letter of credit or both. The bond protects the city, not the provider.

Under City Code §§ 25-299 and 25-311 it secures proper and complete construction or repair of your facilities, restoration of the right-of-way and your compliance with the construction permit. For communications providers, state law (§337.401(3), Fla. Stat.) limits a construction bond to restoring the right-of-way, for no more than 18 months after the work is done.

The City asks for a $25,000 continuing security fund, which it may reduce, or a bond for one project, sized from the type of facilities, how much of the right-of-way you disturb, the restoration needed and your past performance. If the city calls the bond and the surety pays, you repay the surety — so performance bonds may carry a quick soft credit check, which never affects your score and can inform approval; the premium itself is 2% of the bond amount, $100 minimum.
