Chapter 24 of the Miami-Dade County Code lets DERM, the County’s Division of Environmental Resources Management, require a performance bond before it issues certain water control permits. For drainage work, it comes up on three permit classes: Class II (a drainage system with an overflow or outfall into a water body), Class III (construction in a county-owned or controlled canal right-of-way, reservation or easement) and Class VI (a drainage system on a site with known soil or groundwater contamination, or one that handles hazardous materials).
The bond is not required of every development. The DERM Director decides whether one is needed and can waive it, for example when noncompliance would affect only the permit holder or the work is done by a utility company or a government agency. When a bond is required, it guarantees that you comply with the terms of your permit and protects the public and landowners near the work. Subdivision paving and drainage improvements are a separate matter: the County’s Platting and Traffic Review Section takes a cashier’s check or letter of credit for those, not a surety bond.
The amount is determined by the DERM Director and assessed by DERM’s Water Control Section, and Chapter 24 caps it by reference to the estimated cost of the work. If the county calls the bond and the surety pays, you repay the surety — so stormwater bonds may carry a quick soft credit check, which never affects your score and can inform approval; the premium itself is 2% of the bond amount plus a $25 fee, $125 minimum.
