What the process server bond guarantees

Florida’s Process Server Act lets the chief judge of each judicial circuit certify private process servers (Fla. Stat. §48.25–48.31). To be designated, an applicant must meet the circuit’s requirements under §48.27 — including executing a $5,000 surety bond, renewable annually. The 5th Judicial Circuit serves Citrus, Hernando, Lake, Marion, and Sumter counties.

The bond runs for the benefit of any person wrongfully injured by the process server’s malfeasance, misfeasance, neglect of duty, or incompetence in connection with their duties. It is a guarantee that you serve process honestly and competently.

It is not insurance for you. If a harmed party recovers on the bond, you repay the surety. Because certification is valid for one year and renews annually, the bond renews with it — we track it and notify you 60 and 30 days out. If you serve in more than one circuit, each circuit requires its own $5,000 bond.

Fla. Stat. §48.27 (Process Server Act)Under Fla. Stat. §48.27, a certified process server designated by a circuit’s chief judge must execute a $5,000 surety bond, renewable annually, for the benefit of any person wrongfully injured by the server’s malfeasance, misfeasance, neglect of duty, or incompetence.
