What the construction bond actually covers

The City of Orlando issues right-of-way and engineering permits through its Permitting Services Division. For a communications services provider, City Code sec. 23.16 makes the construction bond a construction-and-restoration guarantee: it is conditioned on the full and faithful completion of construction and on restoring the public right-of-way to its original condition. The City lists its Construction Bond forms for telecommunications companies only.

It's a three-party arrangement: you (the principal), the surety carrier, and the City of Orlando (the obligee, the party the bond protects). If you abandon the work or leave the City's right-of-way unrestored, the City can recover against the bond to complete or repair the work itself.

City Code names two amounts: $15,000 for a provider’s construction bond, which may drop to $5,000 six months after the City Engineer accepts the restoration (sec. 23.16), and $5,000 for a private owner construction bond (sec. 65.606(b)). City of Orlando Permitting Services DivisionOrlando City Code sec. 23.16(A): before any Engineering Permit whose work will require restoration of the Public Rights-of-Way, "the Communications Services Provider or the contractor performing such work on its behalf shall obtain, pay for and file with the City a construction bond," naming the City as obligee, in the face amount of $15,000; sec. 23.16(B) makes it non-cancelable, for at least 12 months. The City’s Permitting Forms & Documents page lists its Construction Bond form "for telecommunication companies only" and its $500,000 Blanket Construction Bond form "for telecommunications companies only." Sec. 65.606(b) separately requires a $5,000 private owner construction bond, payable to the City, of owners of property next to the right-of-way who work in it.
