Chapter 560 of the Florida Statutes governs money services businesses — money transmitters, payment instrument sellers, and related licensees regulated by the Office of Financial Regulation. Section 560.209 requires a licensee to provide a corporate surety bond, issued by a company authorized to do business in Florida, in an amount the Financial Services Commission determines by rule — driven by factors like business projections, financial condition, annual transmission volume, and number of locations.
It's a three-party arrangement: you (the principal), the surety carrier, and the obligee. The bond is conditioned on your conformance with Chapter 560 — the licensing, recordkeeping, and conduct rules that protect the people whose money moves through your business. The state files it on its own form, OFR-560-06.
It is not insurance for you — if the surety pays a claim, you repay the surety. The bond has to stay continuously on file for as long as you hold the license, and the OFR can require a higher amount as your volume grows; we track the term and send renewal notices 60 and 30 days out.
