What the bond actually guarantees

Florida's Commercial Collection Practices law (Part V of Chapter 559) prohibits engaging in business as a commercial collection agency — collecting commercial claims owed by businesses — without first registering with the Office of Financial Regulation and keeping that registration current. The registration procedure in § 559.545 requires the registrant to furnish evidence of a current $50,000 surety bond, valid for the year of registration, alongside the registration fee.

It's a three-party arrangement: you (the principal), the surety carrier, and the obligee. The bond is issued for the use and benefit of any credit grantor who suffers or sustains loss or damage from a violation of the Commercial Collection Practices part by the registrant — the money you collect on commercial claims has to reach the creditor it belongs to.

It is not insurance for you — if the surety pays a claim, you repay the surety. Registration is annual, renewed between October 1 and December 31 each year, and the bond must stay valid for the year of registration; we track the term and send renewal notices 60 and 30 days out.

Fla. Stat. § 559.545Section 559.545 of the Florida Statutes sets the registration procedure for commercial collection agencies under the Commercial Collection Practices part (Part V of Chapter 559). It requires each registrant to pay the registration fee and furnish to the Office of Financial Regulation evidence of a current surety bond in the amount of $50,000, valid for the year of registration, issued for the use and benefit of any credit grantor who suffers loss or damage by reason of a violation of the part. Section 559.544 makes registration mandatory before engaging in business.
