What the brewery bond actually covers

Florida licenses brewers and manufacturers of alcoholic beverages through the Division of Alcoholic Beverages and Tobacco (ABT), part of the Department of Business and Professional Regulation. Under §561.37, F.S., no manufacturer or distributor license issues until the applicant files a surety bond securing the beverage taxes the state collects.

The bond is filed on form ABT-6032 and conditioned on the prompt payment of all taxes due under the Beverage Law. For a brewer the amount is $20,000 — but where the Division finds your volume is low enough that a smaller bond will adequately secure the taxes, it may accept a lesser sum, in no event below $10,000.

The bond stands behind the taxes you owe — if you fail to remit, the state can recover against it, and if the surety pays, you repay the surety. We issue the amount the Division set, pricing at 1% of the bond amount ($100 minimum), on the form the state names.
