What the ALF resident-trust bond covers

Florida licenses assisted living facilities through the Agency for Health Care Administration (AHCA). When a facility holds or manages residents’ personal funds — for example, acting as representative payee — Fla. Stat. §429.27 requires it to provide security, and a surety bond is one accepted form.

The amount equals twice the average monthly income of the residents whose funds the facility holds, plus the value of any resident property under the facility’s control. The bond is executed by the facility as principal and runs to the AHCA for the benefit of any resident who suffers a financial loss from the misuse or misappropriation of those funds.

It is not insurance for you. If the agency pays a resident on a valid claim, you repay the surety. A facility that owns more than one site can use a single bond covering all residents served. Any surety that cancels or non-renews must give the AHCA 30 days’ notice — so we keep yours continuous and notify you well ahead. The premium is 1% of the bond amount, $100 minimum — priced by your bond amount, not a credit tier; at the standard amounts the application collects no credit information.
