An independent pharmacy that wants to fill prescriptions for patients on an Express Scripts–administered plan has to sign a network provider agreement with Express Scripts, Inc., a pharmacy benefit manager. As a condition of that agreement, Express Scripts' Network Credentialing group requires the pharmacy to post a $500,000 indemnity bond — sometimes called a performance bond — running continuously for a minimum term before it will activate the pharmacy in its network.
It's a three-party arrangement: the pharmacy (the principal), the surety carrier, and Express Scripts (the obligee), protecting the medical plan sponsors whose exposure Express Scripts assumes. If the pharmacy fails to adhere to the provisions of its network agreement, Express Scripts can make a claim against the bond up to the $500,000 penal sum.
It is not insurance for the pharmacy — if the surety pays a claim, the pharmacy repays the surety. Because the exposure turns on the pharmacy's financial strength, the carrier reviews the business's year-end financial statement and the owner's personal financial statement as part of underwriting, alongside a soft credit authorization on the application.
