What the Colchester road maintenance bond actually guarantees

A private road built to serve a subdivision does not become a public Town road automatically. Under Colchester Code of Ordinances Chapter 109 (Roads), § 109-11, before the Board of Selectmen accepts a petitioned road for public use and maintenance, the petitioner must post a maintenance bond equal to 10% of the Town Engineer’s approved cost estimate for the road, or $2,500, whichever is greater, running for one year following acceptance.

It is a three-party arrangement: you (the principal), the surety carrier, and the Town of Colchester (the obligee), with future road users as the protected party. If a defect in the road surfaces during the one-year maintenance period and the petitioner does not correct it, the Town can draw on the bond to make repairs.
