What the hearing aid dealer bond guarantees

Under AS 08.55.150(a), a person who is not licensed as a hearing aid dealer, or as an audiologist under AS 08.11, may not deal in hearing aids, use a title saying they do, or advertise that they do — and AS 08.55.160 makes a violation a class B misdemeanor. DCCED issues the dealer license only to an individual who meets AS 08.55.010(a), including holding an Alaska business license under AS 43.70.020. Physicians and audiologists may deal in hearing aids without this license (AS 08.55.010(b)).

AS 08.55.030(a) requires every applicant to file with the department, at the time of applying, a $5,000 surety bond running to the state. It is conditioned on paying all taxes and contributions due the state and its political subdivisions, and all amounts adjudged against the dealer for negligently or improperly dealing in hearing aids or breaching a contract when dealing in hearing aids. Instead of a bond, subsection (b) accepts a cash deposit, a certificate of deposit payable to the state, or a negotiable security in the same amount.

Subsection (c) requires the surety to stay in force while you are licensed and for three years after you stop being licensed, and no action may be brought on it after that. There is a separate route for staff: under subsection (d), an employee who deals in hearing aids only within that job needs no individual bond if the employer files a $10,000 bond covering its employees. The $5,000 bond on this page is the individual dealer’s bond and does not cover staff. It is not insurance for you — if the surety pays a claim, you repay it.
