What the bond actually guarantees

Alabama regulates who may write bail as a business through the Alabama Bail Reform Act of 1993. A professional bail company — the corporate entity that stands behind the appearance bonds its agents write — must qualify with either a cash-and-securities escrow agreement or an original corporate surety bond of $25,000, filed with the circuit clerk and approved by the presiding circuit judge of the county where the company does business.

It's a three-party arrangement: the professional bail company (the principal), the surety carrier (which must itself be authorized to do business in Alabama and qualified to write bonds by the Department of Insurance), and the county — through its presiding circuit judge — as the obligee. The bond guarantees payment of any judgment absolute entered against the company on a bond forfeiture in that county.

It is not insurance for the company — if the surety pays a forfeiture judgment, the company repays the surety. Once an original continuous bond is on file and approved, the statute does not require a fresh original bond at each annual recertification — but proof the bond remains in force is still due to the presiding circuit judge, so we track your term and notify you before it lapses.

Ala. Code § 15-13-160Code of Alabama § 15-13-160 conditions a professional bail company's qualification on an original corporate surety bond or escrow agreement of $25,000, filed and approved by the presiding circuit judge of the county where the company executes or becomes surety on appearance bonds. The corporate surety must be authorized to do business in Alabama and qualified to write bonds by the Department of Insurance. The statute allows either party to cancel future liability on 30 days' written notice to the circuit clerk. For bonds made on or after September 1, 2023 in a county with a population of 200,000 or more, the statute sets a higher $50,000 amount — confirm your county's threshold before you apply, since it changes the bond amount, not the underwriting.
