What the bond actually guarantees

A commercial co-venturer is a business that runs a charitable sales promotion — advertising that buying its product or service will benefit a named charity. Alabama regulates these promotions under the charitable-solicitation provisions of Code of Ala. § 13A-9-71, administered by the Attorney General.

To register, the co-venturer files a $10,000 bond in which it is the principal obligor. The bond runs to the Attorney General for the use of the state and to any person with a cause of action against the obligor for malfeasance or misfeasance in the conduct of the solicitation — so the public and the benefiting charities have a financial backstop.

Registration runs for one year, expiring September 30, and is renewed by re-filing the bond and fee. It is not insurance for you — if the surety pays a claim, you repay the surety. We track the bond and notify you 60 and 30 days before expiration so your registration stays current.

Code of Ala. § 13A-9-71Code of Alabama 1975 § 13A-9-71 requires charitable organizations, professional fund raisers, commercial co-venturers, and professional solicitors to register with the Attorney General. A commercial co-venturer files a bond as principal obligor in the sum of $10,000, running to the Attorney General for the use of the state and to any person with a cause of action for malfeasance or misfeasance in the conduct of the solicitation. Registration expires September 30 each year. Certain persons are exempt under subsection (f).
