NOTICE TO PROSPECTIVE BIDDERS
The North Carolina Department of Transportation is requesting bids for the following project in Division
One:
DA00706 – Traffic Signal Construction at the intersections of US-158 at Grouse Street/Soundside Dr.,
and US-158 at Lakeside Street in the Town of Nags Head in Dare County
WBS Element: 36249.5165
Contract Dates:
• Bid Submission: Wednesday, October 7, 2026, by 2:00 PM
• Date of Availability: November 9, 2026
• Completion Date: November 19, 2027
There is NO MBE/WBE Goal for this project.
CONTRACTOR PREQUALIFICATION

BID SUBMISSION
To submit a formal bid for this project, all prequalified contractors must adhere to the following directives:
• Proposal Guidelines: Prepare and submit all bids in strict accordance with the Instruction to
Bidders section found within the project Bid Proposal.
• Security Requirements: Provide a mandatory Bid Bond in compliance with Article 102-10 of the
Standard Specifications for Roads and Structures.
• Compliance Notice: Failure to follow the specified guidelines or provide the required bond will
result in the immediate disqualification of your submission.
BID OPENING
The public reading of submissions will take place virtually on Wednesday, October 7, 2026, at 2:00 PM.
• Conference Call Access: Prospective bidders can join via the Division One Conference Call line at
(866) 590-5055 using access code 2659015.
• Punctuality: Please dial into the conference call approximately five minutes prior to the start time
to allow the Department to record attendance. Bid reading will begin promptly at 2:00 PM.
• Alternative Results: If you cannot attend the live call, official bid results will be posted on the
Division One Webpage following the opening.

Notice Regarding Upcoming Buy America Changes
On January 14, 2025, the Federal Highway Administration (FHWA) terminated its General Waiver for
Manufactured Products and established specific Buy America requirements for their use on Federal-aid
highway projects.
This means that as of the following dates, materials defined as manufactured products permanently
incorporated into Federal-aid highway projects will have to be manufactured in the United States.
Key Implementation Dates
• Phase 1: contracts obligated on or after October 1, 2025
o Final assembly of all manufactured products permanently incorporated into Federal-aid
highway projects must occur in the United States.
• Phase 2: contracts obligated on or after October 1, 2026
o Final assembly of all manufactured products permanently incorporated into Federal-aid
highway projects must occur in the United States.
AND
o The cost of U.S.-produced components in manufactured products must be greater than
55% of the total cost of all components.
Definition of Manufactured Products
Manufactured Products are defined as articles, materials, or supplies that:
• Have been processed into a specific form and shape, or
• Have been combined with other articles or supplies to create a product with different properties
than the individual articles, materials, or supplies.
This places greater emphasis on using domestically produced materials on these projects and is
consistent with the Build America, Buy America Act (BABA) under the Bipartisan Infrastructure Law (BIL).
