1. The Secretary of Transportation of the State of Kansas [Secretary] will accept only electronic internet
proposals from prequalified contractors for construction, improvement, reconstruction, or maintenance work in
the State of Kansas, said work known as Project No.:

The general scope, location and net length are:
LIGHTING. I-435/K-5/LEAVENWORTH RD IN WY CO.
2. This is the Proposal of [Contractor] to complete the Project for the amount set out in the accompanying
Unit Prices List.
3. The Contractor makes the following ties and riders as part of its Proposal in addition to state ties, if
any:
4. Contractors and other interested entities may examine the Bidding Proposal Form/Contract Documents (see
paragraph 11 below) at the County Clerk's Office in the County in which the Project is located and at the
Kansas Department of Transportation [KODT] Bureau of Construction and Materials, Eisenhower State Office
Building, 700 SW Harrison, Topeka, Kansas 66603. Contractors may examine and print the Bidding Proposal
Form/Contract Documents by using KDOT's website at http://www.ksdot.gov and choosing the following
selections: "Doing Business", "Highway Contractors" and "Highway Letting Information",and using the links
provided in the Project information for this project. KDOT will not print and mail paper copies of Proposal
Forms. Contractors shall notify KDOT of their intent to bid as a prime contractor by identifying themselves
as a Bid Holder on the website above. Contractors shall furnish this notice no later than 5:00 P.M. on the
Monday preceding the scheduled Letting Date. For a fee, Contractors and other interested entities may order
paper copies of the KDOT Standard Specifications for State Road and Bridge Construction, 2015 Edition,
[Standard Specifications] by using KDOT's website of http://www.ksdot.gov and choosing the following
selections: "Doing Business", "Highway Contractors", "Contractor Resources and "Specifications".
5.Contractors shall use the Bidx.com website to complete and submit the bid form. Project bid forms are
available on Bid Express' website at http://www.bidx.com.
6. Contractors shall only use the Project Bids software to create a proposal and submit an electronic
internet proposal to KDOT using the Bid Express website.
7. The KDOT Bureau of Construction and Materials will only accept electronic internet proposals on-line using
Bid Express until 1:00 P.M. Local Time on the Letting Date. KDOT will open and read these proposals at the
Eisenhower State Office Building, 700 SW Harrison, Topeka, Kansas 66603 at 3:00 P.M. Local Time on the
Letting Date. Bids are read on a conference call at 785-414-8630. The conference ID is 856 616 050#.
8. The Contractor shall execute a contract for the proposed work within ten (10) business days after notice
of the award of the contract.
9. The contractor shall complete work to open the project to unrestricted traffic within _60_ Restricted Days
and shall complete the work within the total Contract Working Days of _80_.

10. The Contractor shall complete the Project according to the plans, Standard Specifications, provisions
identified in the Special Provision List and all other Contract Documents identified in Standard
Specifications subsection 101.3
11. The undersigned declares that the Contractor has carefully examined the Bidding Proposal Form for the
Project. The Contractor understands the following:
A. The Bidding Proposal Form consists of the following documents: the Bidx bid form on the Bid Express
website (which includes DOT Form 202, required contract provisions, and the Unit Prices List), special
provision list, project special provisions, special provisions, Standard Specifications, plans, exploratory
work documents, any additional contract information, any addenda, all questions and answers posted on the Bid
Express website, and any amendments the Secretary provides for the Project. The Contractor can obtain these
documents at KDOT's website (see paragraph 4).
B. The special provision list identifies all required contract provisions, project special provisions and
special provisions that apply to the Project.
C. The Bidding Proposal form becomes the Contractor's Proposal after the Contractor completes the Bidx bid
form, electronically signs the Proposal where required on DOT Form 202, and submits the completed Bidx bid
form documents and bid bond to KDOT using Bid Express. The special provision list, project special
provisions, special provisions, Standard Specifications, plans, exploratory work documents, any additional
contract information, all questions and answers posted on the Bid Express website, and any addenda are
incorporated by reference into the Proposal. These documents are part of the Contractor's Proposal.
D. In electronically signing this Proposal, the Contractor waives the right to claim that the Contractor
misunderstood the contents of the Proposal or the procurement process.
12. The Contractor has inspected the actual location of the work. The Contractor has determined the
availability of materials. The Contractor has evaluated all quantities and conditions. In electronically
signing this Proposal, the Contractor waives the right to claim that the Contractor misunderstood the scope
of the work.
13. SPECIAL PROVISIONS REQUIRING INFORMATION. The following Required Contract Provisions (I-XVII) require the
Contractor to furnish information. The current versions of these provisions are contained in the Bidx bid
form. Some or all of these apply to the Project as indicated in the Special Provision List. The Contractor
shall complete these provisions within the Bidx bid form file. When these documents are required, the
Secretary will reject proposals that fail to contain completed Provisions I, II, III, or IV in the EBSX file,
and may reject proposals that fail to contain completed Provisions V, VI, VII, VIII, IX, X, XI, XII, XIII,
XIV, XV, XVI, or XVII in the Bidx bid form.

14. The funding source for this Project is STATE. On Projects involving City or County funds, the Secretary
acts as the Agent of the City or County and as the administrator of federal or state funds. Each governmental
entity's responsibilities are described in a contract between the entities which is available on request.

ELECTRIC LIGHTING SYSTEM UNIT COST
Prior to award, the contractor shall submit a spreadsheet for the Unit Costs. A spreadsheet template is
available on KDOT’s website - https://www.ksdot.gov/doing-business/highway-contractors/contractor-resources
under “Other Resources”. The completed spreadsheet shall be submitted to the Letting Engineer no later than
noon on the Friday after letting day. Once approved, the spreadsheet will be placed on KDOT’s Exploratory
Site and incorporated into the contract by reference.
The Contractor shall comply with Section 814 of the Standard Specifications when providing and installing
elements of the Electric Lighting System. Add the following at the end of Section 814.4 Measurement and
Payment.
The Contractor will submit a unit cost in this Required Contract Provision for each individual Electric
Lighting item the contract requires. Even though the bid item is a lump sum price, the Engineer will adjust
the lump sum price by any increase or decrease in the quantities indicated in the Summary of Quantities shown
in the plans. To calculate the adjustment, the Engineer will determine the overrun or underrun quantity for
each Electric Lighting System item list in the contract. The Engineer will multiply any overrun or underrun
quantity by the unit cost the Contractor provided below. The Engineer will increase the lump sum price by the
cost of any overruns and decrease the lump sum price by the cost of any underruns. The sum of the unit costs
multiplied by the items listed in the *Summary of Quantities for each site or the entire project must be less
than or equal to the lump sum bid, or the unit cost submittal will be rejected. Contractor will then be
required to resubmit this Required Contract Provision that meets this requirement for the bid to be accepted.
The Engineer will only negotiate or receive new prices on Electric Lighting System items if they were not
identified in the original Summary of Quantities.
Furnished items shall comply with either the List of Prequalified Roadway Lighting Systems and Equipment, or
the specifications in the contract document or otherwise approved by the Engineer.
The Secretary may reject this Proposal if the Contractor fails to complete this Required Contract Provision
before noon on Friday after letting day.

TAX CLEARANCE CERTIFICATE
Answer 'Yes' if the Contractor has a current Tax Clearance Certificate. Answer 'No' if the Contractor does
not have a current Tax Clearance Certificate.

Insert the Tax Clearance Confirmation Number if available at the time of bidding:
Contractors shall have a current Tax Clearance Certificate from the Kansas Department of Revenue [KDOR] at
the time of contract award. The Tax Clearance process is a tax account review by KDOR to determine that the
Contractor's account is compliant with Kansas tax laws administered by the Director of Taxation. The
Secretary will reject the Contractor's Proposal as non-responsive if the Contractor does not have a current
Tax Clearance Certificate at the time of the contract award.
To obtain a Tax Clearance Certificate, the Contractor shall complete and submit to KDOR an Application for
Tax Clearance obtained from KDOR's website at http://www.ksrevenue.org/taxclearance.htm. The Application Form
can be completed and submitted on-line, by mail, or by fax. After the Contractor submits the Application,
KDOR will provide the Contractor a Transaction ID number. The Contractor shall use the Transaction ID number
to retrieve the Tax Clearance Certificate. Decisions on on-line applications are generally available the
following business day.
After the Contractor obtains the Tax Clearance Certificate, the Contractor shall insert on this Required
Contract Provision the Confirmation Number contained in the Certificate or the Contractor shall submit a copy
of the Tax Clearance Certificate to the KDOT Bureau of Construction and Materials by hand delivery, mail,
e-mail or fax. Before awarding a contract, the Bureau of Construction and Materials will authenticate the
Certificate through the Confirmation Number inserted on this Required Contract Provision or contained on the
Certificate submitted.
If the Contractor is unable to retrieve the Tax Clearance Certificate or if KDOR denies the Contractor's
Application for Tax Clearance, the Contractor shall call KDOR's Special Projects Team at 785-296-3199 to
determine why KDOR failed to issue the certificate.
Tax Clearance Certificates are valid for 90 days after issue. To renew a clearance, submit a new Tax
Clearance Application. Information pertaining to a Tax Clearance is subject to change for various reasons,
including a state tax audit, federal tax audit, agent actions, hearings, and other legal actions. The Tax
Clearance Certificate is not "clearance" for all types of taxes the State of Kansas may assess.

SPECIAL PROVISION TO THE

SIGNIFICANT PROJECT
1.0 DESCRIPTION
This project is designated as a Significant Project. A Transportation Management Plan (TMP) was
developed as part of the construction planning process and is included in the Exploratory Documents.
Refer to the TMP for a comprehensive list of Contractor requirements and implementation details. The
TMP is comprehensive documentation of project decisions that impact traffic during construction, and information on
why those decisions were made. The TMP is meant to communicate why some methods are or are not incorporated
into the project, so those decisions are not inadvertently reincorporated after letting. The TMP uses safety and
operational goals to evaluate estimated traffic impacts and the results of the evaluation guide decision making. During
TMP development, safety, and mobility impacts to traffic during construction are estimated and will be mitigated
through the strategies outlined in the TMP. Each strategy, or impact mitigation method, falls under one or more of the
following: Temporary Traffic Control (TTC) Plan; a Transportation Operation (TO) plan and a Public Information (PI)
plan.
Details needed to implement the TTC and TO portions of the TMP requirements are detailed in the plan set
and quantified or are included in other sections of the Contract Documents. Work may be subcontracted according to
subsection 105.9.

3.0 CONSTRUCTION REQUIREMENTS
a. Implement the TMP. Comply with the decisions made and requirements set forth in the TMP and any
Approved Modified TMP. The TMP is a living document and part of the construction project. As such, it must be
implemented and administered. In addition, it can be changed or modified to fit actual or unexpected work zone
conditions, but a modified TMP shall meet or exceed project operational and safety goals, as defined in the original
TMP.
b. Traffic Control Inspector. Provide one person, available 24 hours per day, as the Traffic Control
Inspector. Prior to beginning work on the project provide the following:
• the name of the designated Traffic Control Inspector.
• proof they successfully completed an Advance Work Zone course, ATTSA’s Traffic Control Supervisor
course or an approved equivalent training course; and
• a single 24-hour contact phone number for the Traffic Control Inspector and a backup phone number and
contact person if the Traffic Control Inspector cannot be reached.
c. Traffic Control Inspection. Inspect all traffic control devices and layouts as shown in the Contract
Document. Traffic control devices shall include all Smart Work Zone devices on the project and are subject to the
necessary deductions as listed below in this special provision. Perform Inspection at least once each day while
temporary traffic control is in place. A minimum of one inspection each week shall be performed one hour after
sunset. The daily inspection time may be adjusted with the Engineer’s approval. Suspend or stop traffic control
inspections when temporary traffic control devices are removed or when directed by the Engineer. Inspections will be
performed by the Traffic Control Inspector or a qualified alternate approved by the Engineer.
Upon completion of each inspection, and within 1 business day, provide to the Engineer documentation
detailing:
• the nature and location of any deficiencies.
• corrective measures taken or planned.
• certification that all traffic control devices are clean, in good condition, and properly located, and
• date and time of the inspection and the inspector’s signature.

The Corrective Action Response Time to repair, replace, remove, relocate, or clean traffic control devices,
including pavement marking, is 24 hours. In the event a Construction Sign (Special) is damaged and needs to be
replaced, the Contractor will be allowed to make temporary repairs to the existing sign until a new sign can be
fabricated.
Take corrective action within the Corrective Action Response Time, beginning when any 1 of the following
occur:
• The Engineer notifies the Contractor of a deficiency though the 24-hour telephone number.
• the Engineer leaves a message regarding a deficiency or receives no answer; or
• the Contractor discovers the deficiency.
d. Modifications to the TMP. Comply with the latest TMP requirements approved by the Engineer.
Proposed modifications shall be submitted to the Engineer for approval 14 days in advance of the work. Modifications
may be proposed, as needed to address project conditions, including re-evaluating the safety and mobility impacts to
traffic, comparing new impacts to the original safety and mobility goals, and evaluating new methods to mitigate
impacts.
Submit the Modified TMP with modified traffic control plans and other supporting documents to the Engineer
for approval 14 days in advance of the work. The Modified TMP shall be approved by the Engineer before
implementing modifications.
Include in a Proposed Modified TMP, at a minimum:
• Assessment of all expected impacts against the original performance measures and operational goals for
the project. If traffic modeling software was used to generate the original traffic impact expectations, the
same level of analysis shall be completed for the new conditions. The Engineer, in conjunction with
KDOT Road Design and Traffic Engineering staff, will determine the scope of modeling necessary on a
project-by-project basis.
• Evaluation of available mitigation strategies to reduce impacts within the established performance
measures. Original safety and mobility goals may be modified with the Engineer’s approval and approval
of the Bureau Chief of Traffic Engineering.
• Modification of the TTC and TO plans, as needed, with detailed drawings that comply with the MUTCD,
Traffic Engineering Standard Drawings, Kansas Work Zone Safety and Mobility processes and
procedures, the applicable portions of SECTION 805 including related special provisions.
• Modification of the PI plan, as needed. Coordinate PI plan modification with the designated District
Public Affairs Manager.
The current version of the TMP should be maintained in a Bluebeam session accessible to all project
stakeholders. At the conclusion of the project, an archived version of the Bluebeam session shall be submitted to
KDOT (Traffic Engineering).

4.0 MEASUREMENT AND PAYMENT
The Engineer will measure each day that “Traffic Control Inspection” is completed and documented
according to the Contract Documents. If corrective actions have not begun in the Corrective Action Response Time, the
Contractor is liable for a deduct at the rate of $250 for each deficiency and for each day that the deficiency is not
corrected. The amount assessed will be deducted from payment using the item Contract Deduct. Corrective Actions
Deductions are cumulative until deficiencies are corrected and will be assessed even if the project is in liquidated
damages.
The Engineer will pay for "Traffic Control Inspection" at the contract unit prices is full compensation for the
specified work. No payment will be made while the Contractor is in liquidated damages for failure to complete work
within the Contract Time.
