Applicants may request reimbursement for costs associated with: (1) purchase of land in fee to be held by a Massachusetts tribal government for conservation purposes in perpetuity, including eligible acquisition and due diligence costs; (2) purchase of a perpetual Conservation Restriction, Agricultural Preservation Restriction, or Watershed Protection Restriction under G.L. c. 184, §§ 31-33, including eligible acquisition and due diligence costs; or (3) due diligence costs (title search, appraisal, legal review, environmental assessment, survey, and recording fees) for the donation of land or a restriction to an eligible applicant. Acquired land must be retained predominantly in natural, scenic, or open condition or in agricultural, farming, or forest use in perpetuity. Land must be either subject to a perpetual restriction co-held by the tribal government and a qualified entity, or held by the tribal government subject to a perpetual charitable trust obligation enforceable in Massachusetts courts to maintain the land for conservation purposes.
