The Department of Commerce intends to negotiate, on a sole source basis, a modification to contract 1331L520C13OS0005 with Accenture Federal Services for additional support including post-go-live Hypercare, embedded resource support, transactional backlog resolution, formal Hypercare certification, enhancements to move from Minimum Viable Product to enterprise optimization, organizational change management activities to facilitate adoption and sustainability, and additional licenses and associated operations and maintenance services.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1), as implemented by the Revolutionary FAR Overhaul (RFO) Federal Acquisition Regulation (FAR) Subpart 6.103-1(b): Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The additional implementation support items can only be performed by the existing contractor as they have the knowledge and expertise obtained through the implementation and go-live activities to support them in the immediate period following. Since this contractor has specifically configured the system, no other contractor could have the required knowledge of the system in the timeframe needed to provide the post-go-live support.
As the provision of additional licenses and accompanying operations and maintenance is integrally related to the initial hosting, no other contractor could provide additional licenses associated with the same instance(s) to provide seamless configuration, access, and support for all end users as required.
This pre-solicitation notice is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can fully meet the Government’s requirements may submit substantiating documentation or a request for additional information in writing to the identified point of contact within 15 days after publication of this pre-solicitation notice. Such requests and documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this pre-solicitation notice.
