Solicitation No.: 09242026
Agency: Federal Bureau of Prisons
Project: FCC Yazoo City FY27 Grease Trap Maintenance and Cleaning
Title: Amendment 0001 – Revision to Licensing Requirements
1. PURPOSE OF AMENDMENT
This amendment revises the licensing requirement for offerors responding to Solicitation 09242026.
The original solicitation required:
“The prime contractor must be fully licensed and permitted by the State of Mississippi. Any subcontractor performing work must also be certified.”
Market research and proposal evaluation revealed that no small business primes currently hold the required Mississippi licenses, creating an unintended barrier to competition in a Total Small Business Set‑Aside.
Accordingly, the Government is amending the solicitation to allow licensed subcontractors to satisfy the technical licensing requirement.
This amendment is issued under the authority of:
FAR 15.206(e) (Amendment of solicitations)
FAR 14.404‑1(c)(1) and (2) (Nonresponsive bids and insufficient competition)
2. REVISED LICENSING REQUIREMENT (REPLACES PRIOR TEXT)
New Licensing Clause
“The prime contractor OR the subcontractor(s) performing regulated grease trap pumping, waste removal, transport, or disposal activities must hold all licenses, permits, and certifications required by the State of Mississippi, including but not limited to:
• MSDH Certified Pumper License
• Mississippi solid waste hauling permits
• Mississippi Department of Environmental Quality (MDEQ) disposal authorization
Copies of all licenses relied upon for compliance must be submitted with the offer.”
Clarifications
The entity performing the regulated activity must hold the license(s).
The prime contractor is not required to personally hold Mississippi pumping or hauling licenses, provided that:
A subcontractor performing the licensed portions of work holds all required licenses, and
A signed letter of commitment is included in the proposal.
The prime contractor retains full responsibility for management, oversight, and contract compliance.
3. SOLICITATION CHANGES – COMPETITION IMPACT
This amendment is considered material. As required by FAR:
A. The solicitation is hereby reopened.
B. All offerors may revise and resubmit proposals.
C. A new proposal due date will be established by separate notice.
The Government determined under FAR 10.002 that the revised requirement continues to meet the agency’s minimum needs while enabling competition.
4. OFFER SUBMISSION REQUIREMENTS (UPDATED) Due 11/6/26 12 Noon EST.
Offerors relying on subcontractor licensing must submit:
Copies of all applicable Mississippi licenses
Proof of subcontractor commitment (signed letter or subcontract agreement)
Identification of which entity (prime or subcontractor) will perform which regulated activities
Failure to provide the above documentation will result in an “Unacceptable” rating for the Licensing compliance factor.
5. ALL OTHER TERMS AND CONDITIONS REMAIN UNCHANGED.
The contractor performs quarterly pumping, cleaning, and maintenance of all grease traps at FCC Yazoo City to ensure compliant operation of wastewater systems. Technical cleaning requirements include inspecting tank structure, lids, and seals; performing a full pump-out of all contents with partial pumping prohibited; scraping all internal walls and baffles; and hydro-flushing internal surfaces and resealing lids. The complex contains 11 grease trap units totaling 47,500 gallons across the Camp Zone, Low Security I, Low Security II, and USP-Medium Facility. One prequalification covers both — on this bid and the next.
