What the fuel tax bond actually covers

Wisconsin taxes motor vehicle fuel through licensed suppliers and others liable for the tax, who remit to the Department of Revenue. Under Wis. Stat. § 78.11, the Department may require any person liable for the tax to place security — before or after a license is issued — as a guarantee of the fuel tax, interest, and penalties they may owe.

When required, the security can be a surety bond payable to the state, and the amount may not exceed three times the licensee's average monthly tax liability. The Department can increase or decrease the amount as it deems necessary. If an applicant or licensee fails to place the security, the Department may refuse to issue or may revoke the license.
