What the on-premise banquet bond guarantees
The on-premise banquet license is the licence a venue needs before it may store, sell, offer for sale, furnish or allow consumption of an alcoholic product in connection with its banquet and room service activities. Section 32B-6-603 lists the venues it covers: a hotel, a resort facility, a sports center, a convention center, a performing arts facility, an arena, a restaurant venue, or an amphitheater. It is a catering and events licence, not a bar licence.
The bond runs under Utah Code 32B-5-204, the general bond section for retail licensees. It is posted in the amount the relevant part specifies — here $10,000 — payable to the department, in a form approved by the attorney general, conditioned on the licensee's faithful compliance with Title 32B and the rules of the commission, and maintained for as long as you operate under the licence.
It is not insurance for you. If the department claims and the surety pays, you repay the surety. Note the statutory teeth: a cancellation caused by your negligence can draw a $300 reinstatement fee; no part of the bond may be withdrawn while the licence is in effect or a revocation is pending; the bond may be forfeited if the licence is revoked; and the department may claim for money owed it without the commission first revoking the licence. A state agency or political subdivision applying for this licence is not required to post a bond at all.
