Why a TRO needs security first

A temporary restraining order is emergency relief. Under Rule 680 it can be granted without notice to the other side when a sworn petition or affidavit shows immediate and irreparable injury before notice can be served and a hearing had — which means someone is restrained before they have been heard.

That is why Rule 684 puts the applicant on the hook first. The TRO bond is filed with the clerk before the order issues, runs to the adverse party, and guarantees you will abide the court’s decision and pay any sums of money and costs adjudged against you if the order is dissolved in whole or in part.

The order itself is short-lived: a TRO granted without notice expires within the time the court fixes, not to exceed fourteen days, and can be extended for a like period for good cause shown, or for a longer period if the restrained party consents — with no more than one extension unless later ones are unopposed. Because the surety stands behind the full sum, a large penal amount can require collateral and financials, and we tell you what your file needs before you commit.

Texas RuleTex. R. Civ. P. 684 provides that in the order granting any temporary restraining order or temporary injunction, the court shall fix the amount of security to be given by the applicant, and that before issuance of the order the applicant shall execute and file with the clerk a bond to the adverse party, with two or more good and sufficient sureties, to be approved by the clerk, in the sum fixed by the judge, conditioned that the applicant will abide the decision which may be made in the cause and will pay all sums of money and costs adjudged against him if the order is dissolved in whole or in part. Rule 684 adds that the trial court’s discretion in fixing the amount of the bond is subject to review. Tex. R. Civ. P. 680 provides that a temporary restraining order granted without notice shall expire by its terms within such time after signing, not to exceed fourteen days, as the court fixes.
