About this bond

What it is and who needs it.

What the public official bond actually covers

A public official bond is a faithful-performance guarantee. Texas conditions a number of public offices on the officer filing a bond before taking the oath, so that if the officer fails to faithfully perform the duties of the office or mishandles public funds, the harmed public body can recover against the bond.

The required amount and approving authority vary by office. For example, a county treasurer files a bond payable to the county judge, set by the commissioners court within statutory limits (not less than $5,000, not more than $500,000); tax assessor-collectors, clerks, constables and others have their own bonding statutes. Your appointment papers or the governing statute will name the figure.

Because the amount is office-specific, we issue whatever figure you were told to post — priced at 0.35% of that amount, $100 minimum, via a soft credit pull that never affects your score. If the surety ever pays a claim, you repay the surety; it is a guarantee to the public, not insurance for the officeholder.

Texas official-bond statutes (office-specific)Texas requires faithful-performance bonds of many public officers under office-specific statutes — for example, Local Government Code §83.002 sets a county treasurer's bond (payable to the county judge, fixed by the commissioners court at not less than $5,000 nor more than $500,000), with separate provisions for tax assessor-collectors, clerks, constables and others. The amount and approving authority depend on your office; confirm the figure with your appointing authority or governing statute, and we'll issue it.

You need this bond if you are

An elected officer taking office whose position requires an official bond before the oath
An appointed official filling a vacancy that carries the same bond as the elected seat
A county or district officer — treasurer, tax assessor-collector, clerk, constable and similar
Renewing or re-bonding for a new term or after the bond amount was reset

FAQ

Common questions.

How much is a Texas public official bond?Pricing is 0.35% of your bond amount, with a $100 minimum. The bond amount itself is set by the statute governing your office or by your governing body — we do not set it. Enter that figure at the application and your exact price appears.
What amount should I choose?Use the exact figure named in your appointment papers or in the statute that governs your office. Amounts vary widely by position; for example a county treasurer's bond is fixed by the commissioners court within a statutory range. If you are unsure, ask your appointing authority and send us the figure.
What does the bond guarantee?Faithful performance of the duties of the office and proper handling of public funds. If the officer fails and the public body is harmed, it can recover against the bond — and if the surety pays, the officer repays the surety.
Is there a credit check?Yes — a quick soft credit check may apply, and it's always a soft pull that never affects your score. Your bond amount sets the exact price — 0.35% of that amount, $100 minimum — the credit check affects approval only, never price.
Who approves and holds the bond?It depends on the office — often the county judge, commissioners court, or the appointing authority. We issue the executed bond ready for you to deliver to whoever approves it.
