About this bond

What it is and who needs it.

What the Texas DME supplier bond actually guarantees

Texas Medicaid is administered by the Health and Human Services Commission (HHSC), and providers enroll through its claims administrator, the Texas Medicaid & Healthcare Partnership (TMHP), in the Provider Enrollment and Management System (PEMS). The DME handbook of the Texas Medicaid Provider Procedures Manual makes this bond a condition of enrollment and continued participation for every newly enrolling and re-enrolling DME provider, and a DME provider must be Medicare-certified before it applies. Texas calls the provider type DME; DMEPOS is the Medicare term for the same suppliers.

The bond guarantees that you will repay HHSC any uncollected overpayments: Medicaid payments you received but were not entitled to keep, and have not paid back. HHSC is the sole obligee, and no one but HHSC, its contractors or its designated agent can bring an action on the bond. The surety pays a valid claim within 30 days of written notice and supporting evidence, its total liability never exceeds the penal sum however many years the bond runs, and it stays liable for overpayments from the bond term for two years after the bond ends unless a new bond replaces it. It is not insurance for you — if the surety pays HHSC, you repay the surety.

The filing rules are specific. The bond must be at least $50,000 for each enrolled location (one bond can cover several, with a list of the locations attached), written on the State of Texas Medicaid Provider Surety Bond Form (F00092) — TMHP accepts no other form — and issued as a continuous bond with a 12-month term. Its effective date can be no later than the day you submit your enrollment application, and no earlier than 12 months before it. Each year you file proof of continuation for the new term before the current one ends; we send renewal notices 60 and 30 days out to keep your filing continuous.

TMPPM DME Handbook §2.1.2 · 1 TAC §352.15The Texas Medicaid Provider Procedures Manual (Vol. 2, Durable Medical Equipment, Medical Supplies, and Nutritional Products Handbook, §2.1.2, October 2026) requires all newly enrolling and re-enrolling durable medical equipment providers, as a condition of enrollment and continued participation in Texas Medicaid, to obtain a surety bond that complies with 1 Texas Administrative Code §352.15. The bond must be no less than $50,000 for each enrolled location (§352.15(f) sets the same $50,000 floor), submitted on the State of Texas Medicaid Provider Surety Bond Form (F00092), which designates HHSC as sole obligee, and issued as a continuous bond for a term of 12 months. Form F00092 conditions the bond on payment of uncollected overpayments as defined in 42 CFR §433.304. An entity operated or administered by a federal, state, local or tribal government agency is exempt if it has had no uncollected Medicaid or CHIP overpayments in the preceding five years (§352.15(d)), and a Medicare bond naming CMS as obligee does not satisfy the requirement. Confirm your enrolled-location count against your PEMS enrollment.

You need this bond if you’re

✓
Enrolling as a Texas Medicaid DME provider — the bond must be in effect the day your PEMS application is submitted
✓
Re-enrolling or revalidating — TMHP asks for the bond again at revalidation and re-enrollment
✓
Adding an enrolled location — each location carries its own $50,000 of bond amount
✓
Replacing a cancelled bond — HHSC does not reimburse a provider that must be bonded for any period without a current bond
After you buy

Claims, renewal, filing, and what sets the price.

If a claim is made

A claim comes from the party the bond protects, the obligee named on the form, when the duty the bond guarantees is not met.

The surety investigates and pays a valid claim, up to the bond amount. You then repay the surety: a surety bond is a guarantee of your performance, not insurance for you.

Renewal and term

The premium covers a one-year term from the effective date you choose.

Renew before the expiry date to keep the bond in force: the license, permit or contract it backs expects continuous coverage.

How to file it

Upload in PEMS. Submit the executed bond and the power of attorney with your enrollment, revalidation or re-enrollment in PEMS. The effective date must fall no later than the day you submit. Wet-ink original mailed on request.

What sets the price

The premium is 2% of the bond amount, $100 minimum: the amount the obligee sets moves the price, not your business profile.

FAQ

Common questions.

How much is the Texas Medicaid DMEPOS supplier bond? The premium is 2% of the bond amount. TMHP requires at least $50,000 for each enrolled location, so a supplier with one location enters $50,000, and the calculator shows the exact premium for any amount before you apply. You never pay the bond amount itself — it is the surety’s limit of liability to HHSC, not a deposit.
What amount should I enter? At least $50,000 for each enrolled location the bond covers: $50,000 for one location, $100,000 for two. One bond can cover several locations if you attach a list giving each location’s d/b/a, physical address and NPI. Several Medicaid provider numbers at the same practice location, such as a DME record and a specialized custom wheeled mobility record, need only one bond.
Does my Medicare DMEPOS bond count? No. TMHP says a surety bond obtained for the Medicare program, which lists the Centers for Medicare & Medicaid Services (CMS) as obligee, does not fulfill the Texas Medicaid requirement. The two are separate filings: Texas requires DME providers to be Medicare-certified before they apply to Texas Medicaid, and this bond runs to HHSC on Form F00092 instead of to CMS.
Is there a credit check? The application includes a credit consent, but it authorizes a soft credit pull only — a soft inquiry that never affects your score. No hard inquiry ever runs on this bond. Your premium stays 2% of the bond amount either way.
Where do I file it, and how does it renew? In PEMS, TMHP’s Provider Enrollment and Management System, with your enrollment, revalidation or re-enrollment, together with the surety’s power of attorney. The handbook asks for the bond form with original signatures, so we mail the wet-ink original on request. The bond is continuous with a 12-month term: each year, file proof of continuation for the new term in PEMS before the current term ends, or your enrollment status is at risk. We send renewal notices 60 and 30 days out.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
