What the health spa bond actually covers

Texas regulates health spas under Occupations Code Chapter 702, which reaches franchised health clubs — including an Anytime Fitness location — the same as any independent gym or fitness studio selling memberships. The Secretary of State may not issue a health spa operator’s certificate of registration unless the applicant files a surety bond (or other approved security) sufficient to protect the spa’s members — §702.151.

The bond is payable to the state for the benefit of members: a member who suffers actual financial loss when a location closes can bring an action on the bond and recover the unused or unearned portion of their dues. The Secretary of State sets the required amount by the location’s total prepaid memberships, and the statute itself sets a floor of $20,000 and a ceiling of $50,000; this bond is our product for the $25,000 tier.
