What the bond actually guarantees

Tennessee licenses non-depository consumer lenders as industrial loan and thrift companies under Title 45, Chapter 5. Registration runs through the Department of Financial Institutions, and T.C.A. 45-5-202 conditions a certificate of registration on a $50,000 surety bond payable to the state — or a letter of credit in the same amount, in a form the Commissioner approves.

It is a three-party arrangement: you (the principal), the surety carrier, and the State of Tennessee (the obligee). The bond runs for the benefit of any person injured by the wrongful act, default, fraud, or misrepresentation of the registrant or its employees. Only one bond is required per registrant, no matter how many offices you operate.

It is not insurance for you — if the surety pays a claim, you repay the surety. The statute also requires the bond to stay in place for at least 24 months after a certificate expires, is revoked, is suspended, or is surrendered, so we track the term and send renewal notices 60 and 30 days out.

T.C.A. § 45-5-202Section 45-5-202 sets the procedures for registration under the Tennessee Industrial Loan and Thrift Companies Act. An applicant files with the Commissioner of Financial Institutions a $50,000 surety bond payable to the state, or a letter of credit in the same amount, in a form approved by the Commissioner, for the benefit of any person injured by the wrongful act, default, fraud, or misrepresentation of the registrant or its employees. Only one bond is required regardless of the number of offices, and the bond must be maintained for not less than 24 months following expiration, revocation, suspension, or surrender of the certificate of registration.
