What the blanket performance bond covers

Under ORS 374.305, no one may build, construct, or place anything in the right of way of an Oregon state highway without ODOT's written permission — a highway permit. ODOT issues single-use permits for one-off work and blanket permits for contractors and utilities that work in the right of way regularly.

ODOT can condition a permit on a performance bond. A blanket bond covers all of your permitted work at once — grading, leveling, drainage, paving, pipe and utility installation — so you don't post a separate bond for every job. The bond guarantees you complete the work to ODOT's specifications and restore the right of way.

If you don't perform — incomplete work, damage to the road, or failure to restore the site — ODOT can recover against the bond to fix it. It is not insurance for you: if the surety pays, you repay the surety. We issue the amount ODOT set at a flat 3% with no credit check.
