What it is and who needs it.

What the bond actually guarantees

Oklahoma licenses commercial marijuana growers through the Oklahoma Medical Marijuana Authority. Since Senate Bill 913 took effect in April 2023, every applicant for — or holder of — a commercial grower license must file a bond satisfactory to the Authority in an amount no less than $50,000 for each license, written by a surety qualified to do business in Oklahoma. The only alternative the statute allows is an attestation that the licensee has owned the permit area for at least five years.

It is a three-party arrangement: you (the principal), the surety carrier, and the Oklahoma Medical Marijuana Authority (the obligee). The bond is tied to the land — it covers the permit area where the growing operation runs, and it stands behind reclamation of that site: removing equipment, destroying waste, remediating environmental hazards, restricting public access, and the final disposition of seized property if a license is revoked.

It is not insurance for you — if the surety pays a claim, you repay the surety. OMMA can require more than $50,000 where the reclamation exposure is larger, and a bond that expires has to be renewed before the 30-day mark ahead of its expiration date or the license faces revocation, nonrenewal, or monetary penalties. We track the term and send renewal notices 60 and 30 days out.

63 O.S. § 427.26 · OAC 442:10-5-3.3Section 427.26 of Title 63 requires every applicant for a commercial grower license, and every commercial grower licensee, to file with the Oklahoma Medical Marijuana Authority a bond satisfactory to the Authority in an amount no less than Fifty Thousand Dollars ($50,000.00) for each license sought or held, with a surety company qualified to do business in this state. The bond amount must be sufficient to assure completion of the reclamation plan if that work falls to the Authority or the Department of Environmental Quality, and is used to defray the cost of restoring the property. OMMA's implementing rule, OAC 442:10-5-3.3, repeats the $50,000-per-license floor, requires the surety to hold authorization from the Oklahoma Insurance Department, permits a five-year land-ownership attestation in place of the bond, and requires expiring bonds to be renewed prior to thirty days before the expiration date.
