What the bond actually guarantees

Ohio licenses precious metals dealers — businesses that buy, sell, or trade gold, silver, platinum, and similar items — through the Division of Financial Institutions within the Department of Commerce. R.C. 4728.03 conditions licensure on financial responsibility: an applicant must show a $10,000 net worth, or in the alternative, obtain a corporate surety bond of not less than $10,000, payable to any person injured by a violation of the chapter, and to the state for the benefit of any person so injured.

It's a three-party arrangement: you (the principal), the surety carrier, and the protected party is anyone harmed by a violation of R.C. Chapter 4728 — customers who sell or pawn precious metals to a licensed dealer. If a dealer violates the chapter's requirements and a person is injured as a result, that person (or, for the state's benefit, the Division) can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. A dealer who files the bond is exempt from the ongoing net-worth requirement, but must keep the bond in force for at least two years after ceasing precious metals dealer business in Ohio, so we track it and notify you ahead of renewal.

R.C. 4728.03Ohio Revised Code 4728.03 requires a precious metals dealer applicant to demonstrate a $10,000 net worth or, in the alternative, obtain a corporate surety bond of not less than $10,000, issued by a surety authorized to do business in Ohio, in favor of any person injured by a violation of R.C. Chapter 4728 and of the state for the benefit of such a person. A licensee that files the bond must maintain it for at least two years after ceasing to conduct precious metals dealer business in the state.
