What the Exempt Company registration actually is

North Dakota's Money Brokers Act and Residential Mortgage Lenders Act exempt certain entities from full state licensure — banks, credit unions, savings and loan associations, insurance companies, trust companies, and several other categories are named exemptions from those chapters. A company that fits one of those exemptions but still does business connected to North Dakota lending, or that sponsors individuals who must be licensed as mortgage loan originators, typically still needs a company record on the Nationwide Multistate Licensing System (NMLS) — the registry the Department of Financial Institutions and its sister agencies across the country share.

That record is commonly called an Exempt Company registration: it identifies the company, links it to any licensed individuals it sponsors, and keeps the Department's oversight of North Dakota lending activity complete even where the company itself does not need a full money broker or residential mortgage lender license.
